Nigerian regulatory and operating context

  • Confidentiality and competence. The Rules of Professional Conduct for Legal Practitioners require lawyers to keep client information confidential, and the Nigerian Bar Association expects lawyers to take care over how they handle it. Choices about cloud storage, remote access and outsourcing IT should support those duties.
  • Professional guidance. Check the guidance and rules of the Nigerian Bar Association on technology, and ask providers where data is stored and who can access it.
  • Client accounts and records. Professional rules and your engagement terms set expectations for handling client money and keeping records, so systems holding these records need reliable backups and access controls.
  • Data protection. The Nigeria Data Protection Act 2023 (NDPA), enforced by the Nigeria Data Protection Commission (NDPC), governs personal data handled by firms, including notifying the NDPC within 72 hours of becoming aware of a breach likely to risk people's rights and freedoms, and rules for transfers outside Nigeria.
  • Local realities. Power and connectivity interruptions are a routine planning factor for court filing deadlines and client work, so resilience belongs in the plan.
