Nigerian regulatory and operating context

  • NCC oversight. Telecommunications and internet service providers in Nigeria operate under the licensing and regulation of the Nigerian Communications Commission (NCC). Confirm the licence category, conditions and reporting duties that apply to your services with the NCC and your advisers.
  • Consumer protection and unsolicited messages. The NCC publishes consumer protection rules and rules on unsolicited messages, including the Do-Not-Disturb service. Portals, billing and messaging systems should support these requirements.
  • Critical infrastructure security. Operators of critical national information infrastructure have security and incident-reporting duties under the Cybercrimes Act (as amended) and to ngCERT. Track the requirements that apply to you with your advisers and build sound security practices now.
  • Funding programmes. Public or development-finance broadband programmes may come with reporting requirements on build progress and service levels that your systems need to support.
  • Data protection. Subscriber information is personal data under the Nigeria Data Protection Act 2023 (NDPA), enforced by the Nigeria Data Protection Commission. Breaches likely to risk individuals' rights and freedoms must be notified to the NDPC within 72 hours of becoming aware of them, and rules apply to transfers of personal data outside Nigeria.
